Two bills seek to stop separation at the border

NATION, Sen. Tim Scott (R-SC): I wanted to provide an update that Senator Scott has joined two legislative efforts aimed to help prevent migrant families from being categorically separated at the border. 

Below are details of each of the pieces of legislation, including a short description on what they would help accomplish:


Protect Kids and Parents Act (authored by Senator Ted Cruz, R-TX)

·         Double the number of federal immigration judges, from roughly 375 to 750.

·         Authorize new temporary shelters, with accommodations to keep families together.

·         Mandate that illegal immigrant families must be kept together, absent aggravated criminal conduct or threat of harm to the children.

·         Provide for expedited processing and review of asylum cases, so that—within 14 days—those who meet the legal standards will be granted asylum, and those who do not will be immediately returned to their home countries.


Prohibits Family Separation and Protects Children at Risk of Harm (authored by Senator Thom Tillis, R-NC)

·         Requires the Department of Homeland Security to keep immigrant families together, including minor children, at residential centers pending the outcome of their civil or criminal immigration proceedings.

·         Incorporates suggestions from the Keeping Families Together Act by requiring a child to be removed from an individual only in instances where the individual presents a clear danger to the health and safety of the child, the government cannot confirm a legitimate parental relationship, the parent has a history of committing violent felonies, or if the child has been a victim of sexual or domestic abuse or trafficking.

·         Authorizes More Immigration Court Judges to Prioritizes Adjudication of Family Cases

·         Provides More Resources for Family Residential Centers and Sets Mandatory Standards of Care
